―International marriage broker (IMB) – ―a corporation, partnership, soleproprietorship, or other legal entity that does business in the United States
and offers to Maryland residents dating, matrimonial, or social referral
services involving recruits [foreign female clients] by:
(1) exchanging names, telephone numbers, addresses, photographs,
or statistics or otherwise facilitating communication between a
client [US male client] and a recruit [foreign female client]; or
(2) providing a social environment for introducing clients [US male
clients] to recruits [foreign female clients] in person.

This Advisory is intended to help hold international marriage brokers (IMBs) accountable for failing to comply with federal and state laws that regulate IMBs in order to prevent the abuse and exploitation of foreign brides. The Advisory outlines for prosecutors, attorneys, victim-advocates, and others, the various legal remedies—at the federal and state level, both civil and criminal, initiated by prosecutors or pursued by the abused women themselves—that may be available when a woman is abused by a man she met through an IMB. These remedies include:

Federal law: IMBs that fail to comply with the ―International Marriage Broker Regulation Act (IMBRA) can be both fined (up to $25,000 per violation) and jailed (up to five years). (See Part II)
State law: In addition to IMBRA, several states have their own laws regulating the IMB industry, with additional fines or penalties for an IMB‘s non-compliance under state law. (See Part III and Appendix)
Private lawsuits: Abused women can also file private lawsuits for monetary damages based on claims like fraud or negligence. (See Part IV)
Other protections and resources for abused foreign brides: The Violence Against Women Act (VAWA) and the Trafficking Victims Protection Act (TVPA) may provide immigration remedies for women in IMB-initiated relationships who have been victims of domestic violence, sexual assault, human trafficking, or other serious crimes in the United States. (See Part V)
The Tahirih Justice Center (Tahirih) is a nonprofit organization that through direct legal services, public policy advocacy, and education, works to protect immigrant women and girls in the United States who are fleeing violence. Tahirih spearheaded the drafting of IMBRA, the first comprehensive federal statute to regulate IMBs, and mobilized the nationwide coalition that advocated for IMBRA‘s passage. Tahirih now acts as an expert resource on IMBRA, as well as a national referral resource for women abused by men they met through IMBs.

The further plans for IMBRA are starting to develop. On October the 27th, there was an information pamphlet issued by the United States Citizenship and Immigration Service. Why is this pamphlet been published now? That’s exactly the question being asked by citizens (women and men) regarding a now passed bill in the Maryland General Assembly. See below.

The state of Maryland has brought to law in recent weeks the “International Marriage Brokers Regulation (IMBR)”. This will restrict men’s rights to use dating sites to meet foreign women and will likely spur copycat legislation in other states.

Translator fraud: Guys writing to translators as opposed to the actual woman are an often heard complaint when working through agencies. Lets spin the coin on that one for a moment. Olga Maslova of Ladagirl.com, has had many women ask her to “weed out” the unsuitable men by writing on their behalf in the early stages. She refused to do it, insisting that women reply to all mail personally, and as a result, some women pulled out saying, “I have to time to talk crap to fat old guys/poor guys/losers/guys with no passport/guys who are not ready to step on a plane. Find me a nice professional guy who isn’t too old, isn’t a whack job, and doesn’t look like a bulldog chewing a wasp and I’ll take over then”. Is that so unexpected? You may be a well-adjusted, normal dude, but consider some of the otherblokes who enter this endeavour. Isn’t it sensible that some women use their agency as a kind of PA to weed out the no-hopers at first base? Women have told us that most local agencies will do this for them.

Early stage contact information for everyone may subject her to an avalanche of nonsense ranging from “scam checks” involving someone pounding at her door with a droopy $3 flower hoping to thrust a camera in her face to “prove” she is real, through to flurries of SMS messages in free Google translated garbled Cyrillic that makes no sense. Sex tourists and would-be stalkers at her door are a far smaller, but quite possible consequence of her address being for sale. Men posting her personal details on so-called scam sites — simply because they were rejected — is something that is quite likely and indeed we saw here at RUA with a certain ex-member. For her, the upsides are minimal. The advantage to early stage direct contact information is mostly beneficial to the men.
